Employing human beings is not for the faint of heart or the risk adverse. Dealing with employee requests for leave and accommodations for disabilities is one of the many challenges faced by Colorado employers. What is a “disability” under the law? Is being grouchy a disability? Compulsive gossip? When can behaviors that, on their face, look like an attempt to annoy, actually be proof of a disability that requires accommodation? What kind of accommodation is “reasonable?” Is unlimited leave a reasonable accommodation? How much notice does an employee need to provide in requesting an accommodation? How does the Americans with Disabilities Act interact with mandatory Colorado sick time? The FMLA? What must an employer do? What obligations does an employee have? Is it possible to discipline an employee protected by the ADA? This training will address the basics of the ADA and help employers troubleshoot the complicated issues raised by real humans.
