CCCAP Waiver Approved by Feds

What Does This Mean?

As of last week we were told that various counties operating CCCAP programs would not be fully operational again until around 2028.  The cost drivers?

1) Increase in provider rates (were below 50% at the time of the audit and are now at 75%)

2) Counties that overexpended in the state that negatively impacted counties that were not

3) The items that would have been required by the 2024 CCDF rule set

4) HB24-1223 requirements.

We have asked the state to provide us with additional information for CCCAP programs for localities including:

# Children Served
# Families Served

Total Federal/State/County funding amount

This information will help us to clearly see what IS happening at each local level and what an average cost per CCCAP child is.  Our belief is that this transparency will make it easier for us to support you as you advocate with your board of county commissioners commissioner who oversees their local DHS.

PLEASE NOTE:

Dr. Roy is stating that the 7% cap for families is NOT required by federal law but instead by HB24-1223.  Please see the fiscal note for HB24-1223....it CLEARLY indicates that this is not the case, as do several of the CDEC documents for the CCCAP Rule Rewrite Committee:

OUR ADVOCACY ON THIS ISSUE IS JUST STARTING TODAY AS WE WERE JUST NOTIFIED OF THEIR INTENT TO PROCEED WITH THAT NEW RULE AS "REQUIRED BY HB24-1223".    It represents $5.8 Million in funds for copayment caps alone.  It is our feeling that the fiscal note, etc. indicates that those pieces were to be implemented ONLY with funding support.

We will keep you updated on CCCAP as this evolves.
